1 Scope of application
The following terms and conditions are set forth between Zagara and the customer.
All products available on the Zagara website/ catalogue are the intellectual properties of Zagara.
You will enter into a binding purchase contract when placing an order and enabling a purchase through COD (Cash on Delivery), credit card or bank transfer. The receipt of the order or also known as the acceptance of the order will be send by an email.
3 Exchange Policy
The customer has the right to exchange an order within 7 days of taking possession of the goods if the product has not been opened from its original packing and/ or utilized.

Gift vouchers can only be redeemed in products and are not subject to be disbursed in cash.
Consequences of cancellation
If the order is cancelled, Zagara will reimburse all payments received including delivery cost unless the delivery method chosen by the customer is other than the cheapest standard delivery service offered by us. The reimbursement will be completed within a minimum of fifteen days of receiving the goods or proof that the goods have been dispatched. Reimbursements will be processed using the same mode of payment as the purchase. The client will bear all costs associated with the returning the product to Zagara.

Delivery of products will be ex works Zagara to delivery address provided by the customer.
Details regarding availability, shipping or delivery of products are estimated and should not be constituted as a guarantee or binding agreement unless expressed by Zagara as a binding deadline/guarantee. If Zagara is unable to deliver the goods for unforeseen reasons/ circumstances beyond its control, Zagara is within its rights to cancel the order with the customer. In such scenario, the customer will be informed without delay of the cancelled order.
4b Faulty delivery
Where an incorrectly assembled delivery or defective goods are involved, the costs for returning the goods are borne by Zagara. In this event provide us with the order number and the reason for returning.
5 Shipping costs
The current fixed charges can be found on our website at www.zagara-uae.com. Prices are subject to change without notice.
Customers can opt to settle their payments via COD (Cash on Delivery) if available for that particular city or area, online payments via payment gateway (if available), or bank transfer. Information will be emailed to clients once a purchase order has been generated in our system. UAE clients can also choose to settle payments via cash on delivery.
7 Compensation, retention
Customer is entitled to compensation if the claims are undisputed by Zagara or carry the weight of the law.
Prices stated in the order will apply. Zagara reserves the right to change the prices stated in the catalogue and on the website.
9 Retention of title
Zagara retains ownership to the delivered goods until payment has been made in full.
10 Liability for defects
Whereas the goods are defective subject to delivery, the customer is entitled to return the goods initially delivered within 7 days to Zagara with costs borne by Zagara. The defective goods are to be returned in accordance with the statutory provisions. Zagara reserves the right to claim for compensation under if defects are fraudulent.
12 Item descriptions
Images of the products may slightly differ resulting from different hardware and software. Due to the nature of the manufacturing, scents/ fragrance may slightly differ from the description. Description will be as accurate as possible.
13 Applicable law
The Law of the United Arab Emirates shall apply regardless of customer’s place of jurisdiction.
14 Business with merchants
The aforementioned provisions regarding the right of cancellation and returns do not apply to business with merchants. In these cases, the jurisdiction lies within the courts of the UAE or the economic chamber of Dubai.
15 Severability clause
Individual provisions of these Terms and Conditions having no legal effect in part or in whole, or subsequently losing their legal effect, does not otherwise affect the validity of the Terms and Conditions. The statutory provisions take the place of the invalid one. The same applies where the Terms and Conditions contain an unforeseen gap.
